We are experienced in both federal and state court trial practice and regularly appear in alternative dispute resolution forums. Because of our exceptional research, analytical and writing skills, we are often referred appellate matters by other trial counsel. Examples of clients include real estate mortgage and brokerage firms, corporations and limited liability companies, general and limited real estate partnerships, real estate investors, title insurers, escrow companies, developers, contractors, financial institutions and lenders, insurance companies and individuals. Because of its recognized expertise in these areas, referrals to the firm are often from the legal community. Principal areas of practice include real estate, construction litigation, complex business transactions, environmental law, corporate, limited liability company and partnership law, title insurance, creditors' rights, escrow disputes, lender liability defense, landlord/tenant rights and commercial litigation. As discussed below, we represent all parties in bankruptcy matters as well as pursuing fraud and other nondischargeability claims. Given the nature of litigation, generally we believe it important to be extremely aggressive. However, thoughtless aggression in every case invariably increases the costs of the litigation, and not necessarily with any attendant benefit to the client. We therefore take a carefully calculated case-by-case approach to litigation strategy. Our successes in resolving matters quickly and cost-effectively have earned us a loyal client following.

The Securities & Exchange Commission, the National Association of Securities Dealers, and the New York Stock Exchange were on the opposing side. The case is Jevne vs. JB Oxford and is a not only a high profile case, but a case which has the potential of substantially increasing the level of investor protection in securities arbitrations. Our successful Petition for Review (PDF) was instrumental in securing review in this case. Another landmark California Supreme Court case handled by the Law Offices of Zilinskas & Woosley was Erlich vs. Menezes (1999) 21 Cal.4th 543 (PDF), which dealt with the availability of emotional distress damages in construction defect cases. While ultimately not successful, this case represents an excellent example of the lengths the Law Offices of Zilinskas & Woosley will travel to assist our clients. Finally, a very unusual case and appeal that we handled was an insurance bad faith case in which our client sought coverage and damages from her insurance carrier based on a withdrawal of defense argument. The case was Kafader v. USAA (2002) 2002 WL 31648799, and our successful Opening Brief (PDF) and Reply Brief (PDF) was essential in winning this case.
